Privacy Policy

1. Data Controller. VisualContentWorks, registered at 90000, 18 Faubourg de France, Belfort, France, is the data controller responsible for the processing of personal data collected through this website.

2. Data Collection. We collect personal data you voluntarily provide when contacting us, including your name, email address, phone number, and project details. We also collect standard web analytics data including IP addresses, browser type, and pages visited.

3. Purpose of Processing. Your personal data is processed solely for the purpose of responding to your inquiries, delivering requested visual content services, processing payments, and improving our service offerings.

4. Legal Basis. Processing is conducted under GDPR Article 6(1)(b) — performance of a contract — and Article 6(1)(f) — legitimate interest in responding to business inquiries.

5. Data Retention. Personal data is retained for a maximum of 24 months after the last interaction, unless a longer retention period is required by law or contractual obligation.

6. Data Sharing. We do not sell or rent personal data to third parties. Data may be shared with trusted service providers (hosting, payment processing) strictly for service delivery purposes under data processing agreements.

Terms of Service

1. Service Agreement. By engaging VisualContentWorks for visual content creation services, you agree to these Terms of Service. All services are provided from our office at 90000, 18 Faubourg de France, Belfort, France.

2. Scope of Work. Each project scope, deliverables, timelines, and pricing are defined in a written project brief or proposal accepted by both parties prior to commencement. Any changes to scope require written approval and may incur additional costs.

3. Payment Terms. Invoices are payable within 14 days of issue. A 50% deposit is required before project commencement. Late payments incur a 2% monthly surcharge. All prices are in Euros (EUR) and exclude applicable taxes.

4. Intellectual Property. Upon full payment, all final deliverables and associated intellectual property rights are transferred to the client. VisualContentWorks retains the right to display completed work in portfolio and marketing materials unless otherwise agreed in writing.

5. Revisions. Each project includes up to two rounds of revisions at no additional cost. Additional revision rounds are billed at €75 per round. Revisions must be requested within 14 days of deliverable receipt.

6. Delivery. Final deliverables are provided via secure digital transfer. VisualContentWorks is not responsible for delays caused by client feedback latency, third-party platform issues, or force majeure events.

7. Limitation of Liability. VisualContentWorks' total liability shall not exceed the total project fee paid. We are not liable for indirect, incidental, or consequential damages arising from service use.

8. Termination. Either party may terminate with 14 days written notice. Upon termination, client is liable for all work completed up to the termination date.

Refund Policy

2. Deposit Refunds. The initial 50% deposit is non-refundable once project work has commenced. If cancellation occurs before any work begins, the full deposit may be refunded within 14 business days.

3. Completed Work. Fees for completed and delivered work are non-refundable. If deliverables do not meet the agreed project brief specifications, we will revise the work at no additional cost within the included revision rounds.

4. Partial Refunds. If a project is terminated by the client after commencement, a partial refund may be issued for undelivered work, calculated proportionally based on the project milestone schedule.

5. Refund Process. Refund requests must be submitted in writing to [email protected] within 30 days of the invoiced service date. Approved refunds are processed within 14 business days via the original payment method.

6. Dispute Resolution. In the event of a dispute regarding refund eligibility, both parties agree to attempt resolution through good-faith negotiation before pursuing any formal legal remedies under French consumer protection law.
